How long should I keep my files?

Law Society guidelines state that it may be advisable to maintain records for a minimum of six years from the time the subject matter was fully completed. At the end of the six year period, you should review your files again according to the nature of the particular transactions and the likelihood of any claims arising.

For certain documents, such as contracts/agreements under seal, trade marks, leases and title deeds, the retention period is longer than six years.

Relevant statutory provisions should also be taken into account, for example the requirements of the Value Added Tax Act and the Limitation Act.

Can I destroy my documents after the recommended period?

Before you destroy a file, it is essential to consider who owns which documents. No documents should be destroyed without the prior consent of the owner.

Can I store documents electronically and destroy the originals?

Original documents which are not your own property, such as deeds, guarantees or certificates should not be destroyed without the written permission of the owner.

If the work has been completed and the bill paid, other documents, including your file may be stored electronically and then destroyed after a reasonable time.
